“BALANCING A CORPORATION’S DOCUMENT RETENTION POLICIES WITH THE ADVENT OF ELECTRONIC DISCOVERY”

Discussion: There are approximately 8,500 state and federal regulations that affect corporate compliance and record retention. Some of the most notable are Sarbanes-Oxley Act, Patriot Act, Gramm-Leach-Bililey Act, ISO standards, HIPPA and SEC, NASD and NYSE regulations. In addition, the recently amended Federal Rules of Civil Procedure and associated case law have further imposed corporate obligations regarding the preservation, identification, collection, and production of Electronically Stored Information (ESI). Considering that most surveys indicate that anywhere from 90 to 95% of a corporation’s documents (not to mention email) are created electronically, how these documents are maintained and managed in light of potential litigation obligations is a new challenge for the corporate CIO. This panel will discuss what obstacles the corporate CIO has encountered in balancing record retention on an every day basis with responding to litigation hold notices and electronic discovery requests. Also, how the CIO and corporate counsel bridge the gap to become compliant sound and at the same time litigation ready.
