“BALANCING A CORPORATION’S DOCUMENT RETENTION POLICIES WITH THE ADVENT OF ELECTRONIC DISCOVERY”
Moderated by: Karl Wetzel, VP Electronic Discovery Services, Visual Evidence
| Panelists: |
Philip Oliss, Litigation Partner, Squire Sanders & Dempsey |
| |
Kristi McConnell, Information Compliance Program Manager, First Energy Corp. |
Discussion: There are approximately 8,500 state and federal regulations that affect corporate compliance and record retention. Some of the most notable are Sarbanes-Oxley Act, Patriot Act, Gramm-Leach-Bililey Act, ISO standards, HIPPA and SEC, NASD and NYSE regulations. In addition, the recently amended Federal Rules of Civil Procedure and associated case law have further imposed corporate obligations regarding the preservation, identification, collection, and production of Electronically Stored Information (ESI). Considering that most surveys indicate that anywhere from 90 to 95% of a corporation’s documents (not to mention email) are created electronically, how these documents are maintained and managed in light of potential litigation obligations is a new challenge for the corporate CIO. This panel will discuss what obstacles the corporate CIO has encountered in balancing record retention on an every day basis with responding to litigation hold notices and electronic discovery requests. Also, how the CIO and corporate counsel bridge the gap to become compliant sound and at the same time litigation ready.

WORKSHOP - “FINDING BUSINESS VALUE IN ACHIEVING SOX COMPLIANCE; GOOD GOVERNANCE CAN BE GOOD BUSINESS, BUT FORCING ‘COMPLIANCE’ WITHOUT PREPERATION AND CHANGE MANAGEMENT WILL NOT YIELD THAT RESULT”
Introduction: Mark Stretch, Alliance Partner Advocate, Mid-Atlantic West, CA
Facilitated by: Bob Boetler, Sr. Manager IT Transformation Practice, Bearing Point, Inc.
Business Problem: The integration of Information and Technology into the strategic and internal investment planning of the enterprise brings IT under scrutiny for governance practices.
IT Solution: Commit to a strategic program of ‘Governance Roadmap Implementation’ that delivers incremental business value while building compliant systems and behaviors. IT Governance is much like a living organism. There are many parts and systems that must work together to be healthy and productive. Achieving good governance is an evolutionary process of building on success and adapting to the rapidly changing environment of IT. Taking any of these parts for granted, or trying to function without all systems operational, can lead to unforeseen and undesired outcomes.
